Registered Sex Offenders ARE Living Near Schools NOT listed on Sheriff Website....Submitted by ANGELnWard14 on Sun, 10/03/2010 - 23:26.
ARE ANY OTHER FAMILIES CONCERNED ABOUT THIS MATTER??? ARE YOU AWARE THAT THERE ARE MANY SCHOOLS NOT LISTED ON THE SHERIFF'S WEBSITE??? WHAT DO YOU THINK WE SHOULD DO ABOUT THIS ISSUE??? PLEASE POST YOUR DIRECT OPINIONS ON THIS MATTER BELOW SO THAT WE MAY COLLECTIVELY ENGAGE OUR PUBLIC SERVANTS AND ADDRESS THIS MATTER IMMEDIATELY! In March 2010, I found a notification that a sex offender moved directly across the street from the old BLESSED SACRAMENT CHURCH/SCHOOL. I immediately communicated my concerns to the sheriff's office, which were to be investigated. Later, I realized that not only the new school at this specific location was listed on the Sheriff's website-but neither were over 15 other school locations around our county.... I followed up about my concerns and have not heard anything to date about this issue... What I found out would boggle any parent's brain.... None of the approximately 17 PEP (Positive Education Program Schools are listed on the County Map that allows sex offenders to know that they are within the range of a school. That means that they legally get to move across the street from unlisted schools by some sort of fluke... These children, above all children, are most vulnerable and require the most protection in our community...and they are somehow not covered under this law. I am absolutely ENRAGED by this... To date-non of the officials from the Sheriff's Department, Commissioners, City of Cleveland, or the School leadership themselves have given me a solid answer why these schools are NOT listed in the system! I had found a problem in the system and asked for answers...my efforts to protect the children have evidently fallen on deaf ears or there are Ohio laws that preclude these schools from being added to the rolls of schools in CUYAHOGA COUNTY so that families are aware of who's living near the schools...or within a 1,000 feet of a school. My guess is that this possible "MISTAKE" in putting the schools on the list would cause uncountable registered offenders to be forced to "MOVE" as it would put them in violation of the law. too much work for the county to entertain?????? 1)LAW: According to the Sheriff's website: A Common Pleas Judge must declare and classify an individual as a sexual offender. Further information relative to the classification of offenders can be found in Ohio Revised Code §2950.01 et seq. 2) Sheriff's Website refers to the ORC 2950.01 which then refers you tothe ORC 2925.01 for a definition of a "SCHOOL" (see below)... SECTION 2925.01, Sections (P), (Q), (R), (S) all state stuff about "SCHOOLS" for offenders. (P) An offense is “committed in the vicinity of a school” if the offender commits the offense on school premises, in a school building, or within one thousand feet of the boundaries of any school premises, regardless of whether the offender knows the offense is being committed on school premises, in a school building, or within one thousand feet of the boundaries of any school premises. (Q) “School” means any school operated by a board of education, any community school established under Chapter 3314. of the Revised Code, or any nonpublic school for which the state board of education prescribes minimum standards under section 3301.07 of the Revised Code , whether or not any instruction, extracurricular activities, or training provided by the school is being conducted at the time a criminal offense is committed. (R) “School premises” means either of the following: (1) The parcel of real property on which any school is situated, whether or not any instruction, extracurricular activities, or training provided by the school is being conducted on the premises at the time a criminal offense is committed; (2) Any other parcel of real property that is owned or leased by a board of education of a school, the governing authority of a community school established under Chapter 3314. of the Revised Code, or the governing body of a nonpublic school for which the state board of education prescribes minimum standards under section 3301.07 of the Revised Code and on which some of the instruction, extracurricular activities, or training of the school is conducted, whether or not any instruction, extracurricular activities, or training provided by the school is being conducted on the parcel of real property at the time a criminal offense is committed. (S) “School building” means any building in which any of the instruction, extracurricular activities, or training provided by a school is conducted, whether or not any instruction, extracurricular activities, or training provided by the school is being conducted in the school building at the time a criminal offense is committed. The transcripts of the events follow... Including communications with Sheriff's Dept., the PEP leadership, and notice of this to enumerable community people..at city, county, state, and federal levels along with other investigative reporters....and yet this issue has not been redressed to date!!!!

Today, I was driving by the PEP or Positive Education program and noticed all of the school buses and also one of your sheriff trucks driving down the street. I went inside to address the realization that this IS A SCHOOL for sure...and the staff noted that your people had been there to notify them that there was a predator across the street, listed below. I appreciate that notice to the school, but what happens next with the predator living within the 1000 feet of the school? Has your staff updated the computers to list the PEP Program schools as SCHOOLS so as to prevent this in the future (There are 17 more school locations under the PEP program within our county that I fear may not be in your system.) (See list below).
Moreover, I want to know how we update the sheriff's list of schools to include PEP schools, Charter Schools, Day Cares and whatever schools are currently mistakenly missing from your ability to verify school zones? I am beside myself to have asked for a letterhead and contact info to the Executive Staff of the PEP program county wide-only to find out that there are approximately 17 SCHOOLS that are possibly not listed with your program that tells you whether the offender has moved within a 1000 feet of the school.
I pray with all of my heart that this issue is made a huge priority for the sake of all residents. I know that it is already an overwhelmed issue-but respectfully, as a parent-I am ready for a heart attack about all the families who are unaware of this. I believe that the staff of these schools should be paying attention as well and should have noticed this directly-before now. I know that you all are doing your best and I give you major Kudos for all you do...respectfully.... But for now, I would like to know that this issue of your listing of schools is being updated asap....and the reactions to the many predators living in those areas are met without hesitation.

By the way, I will try calling the City of Cleveland Law Director again. However, I don't have a Point of Contact on that and will work towards addressing it asap. I don't understand the deals with Civil/Criminal in this matter, but only wish to prevent and protect our families the best way possible...most importantly-by getting the right info updated immediately. ---- I am highly concerned about this notification due to the facts below:
1)The residence listed is a "Business"...aka- Pat's Beauty Salon at the corner of Fulton Road and Storer Avenue. (Unless there is a verifiable apartment there????)
2) Directly across the street is Blessed Sacrament Church.
a) Blessed Sacrament used to also be an elementary school.
b) I believe that the "BOY SCOUTS" do their meetings at this location regularly.
c) There is a sign in front of the school that says: PEP (Positive Education Program) which usually means: there is a school inside... Like there is one at 44th & Newark inside the other church school building. Those PEP schools are not always listed as are regular schools.
I checked your program about the school addresses...it said that it was ok. However, I do not feel comfortable about the above facts of concern.
I'd rather be wrong than uncertain for the sake of the notification. Thank you for investigating this concern.

WILL YOU UNITE TO REACT TO THIS SOCIAL INJUSTICE AND HELP TO LOBBY THESE FOLKS WITH YOUR CALLS AND CITIZEN ACTION IN ORDER TO GET THIS CHANGED???
WE MUST UNITE TO UPHOLD DEMOCRACY AND PROTECT OUR FAMILIES!

1) The sheriff's office has notified me that my email & concerns have been forwarded to the appropriate people and then the PEP administrator emailed me the below notice that he WILL contact the Sheriff's Dept.....So, we shall be following up! Thanks for their efforts!

Tell him to get all these non Ohio Department of Education SCHOOLS registered somehow or change the registration laws to include NON DOE recognized places of education in the laws that are supposed to protect kids!!!!
